1. Service Definition
These Partner Terms apply to all businesses listing on The Owners Club worldwide. By creating or maintaining a listing, you also agree to our Privacy Policy.
The Owners Club ("We", "Us", "Our") provides a self-service directory and advertising platform. We are not a garage, repairer, insurer, or agent. We do not perform vehicle work or guarantee the outcome of any service.
Partners ("You", "Your") create and manage their own business listings according to the subscription plan they choose. Vehicle owners browse those listings at their own risk. Any contract for work is strictly between the vehicle owner and the Partner.
2. Your Listings & Self-Certification
You are solely responsible for all information you submit to the platform — including business name, address, contact details, services, pricing, insurance statements, qualifications, logos, photos, and marketing text.
By publishing a listing, you self-certify that the information you provide is accurate, current, and lawful, and that you hold valid business registration and trade insurance where required for the work you advertise.
We do not independently verify, audit, or guarantee your insurance, qualifications, or workmanship. Displaying a listing or status badge is advertising space only — not an endorsement by The Owners Club.
3. Payments, Billing & Subscription Methods
By signing up for a subscription, you agree to the following payment terms based on your selected billing frequency:
3.1 Monthly Plans (Processed via Stripe)
- Card Authorization: By selecting a Monthly Plan, you authorize The Owners Club to charge your nominated credit or debit card immediately for the first month's subscription fee.
- Recurring Payments: You authorize Stripe, our payment processor, to automatically charge your card on a recurring monthly basis until cancellation.
- Failed Card Payments: If a card payment fails (e.g., insufficient funds, expired card), we will attempt to retry the transaction. Paid listing features may be suspended immediately upon payment failure.
3.2 Annual Plans (Processed via Stripe)
- Card Payment: By selecting an Annual Plan, you authorize Stripe, our payment processor, to charge your card annually on or around your renewal date until cancellation.
- Renewal: Annual subscriptions renew automatically each year unless cancelled before the renewal date.
- Failed Payments: If an annual renewal payment fails, access to paid features may be suspended until payment is resolved.
3.3 General Payment Terms
- No Refunds on Partial Periods: Payments are non-refundable regarding partial usage of a billing period.
- Disputes: Any disputes regarding payments must be raised with Stripe or The Owners Club support directly.
4. Cancellation & Refunds
- Monthly Plans: You may cancel anytime via your Partner Dashboard. The cancellation will take effect at the end of the current billing period. No refunds are provided for partial months.
- Annual Plans: Annual plans are non-refundable once the paid listing has been activated or the Professional Photography session has been booked, whichever comes first.
- Photography Costs: For Premium Annual partners, a fee of £500 is deducted from any potential refund if a photography session has already taken place. This covers our upfront costs for professional photography services.
- Immediate Termination: We reserve the right to terminate your subscription immediately without refund if you violate these terms or engage in fraudulent activity.
5. Listing Status & Conduct
Paid plans activate your directory listing and related features. We reserve the right to suspend or remove your listing without refund if you:
- Misrepresent your services, qualifications, insurance, or business credentials.
- Publish false, misleading, or unlawful listing content.
- Receive substantiated complaints regarding fraud, negligence, or serious misconduct.
- Fail to pay subscription fees, have expired card details, or repeated payment failures.
- Engage in any activity that brings the reputation of The Owners Club into disrepute.
- Violate any applicable laws or regulations in the course of your business operations.
Termination is at the sole discretion of The Owners Club. We are not required to provide notice or explanation, though we will make reasonable efforts to do so when possible.
6. Intellectual Property & Media Usage
5.1 Ownership: All photography and videography ("Official Media") produced by The Owners Club, including on-site professional photography sessions, remain the sole intellectual property of The Owners Club. The Owners Club retains the perpetual, irrevocable right to use these materials for its own marketing, portfolio, and platform promotion, regardless of the Partner's subscription status.
5.2 Active License: The Partner is granted a non-exclusive, worldwide commercial license to use Official Media on their own website, social media channels, and physical marketing materials solely while their Premium Subscription is active and in good standing. This license explicitly excludes the use of Official Media on third-party aggregator sites, competing business directories, or general classifieds platforms unless a Buyout Option (5.4) has been exercised.
5.3 Termination: Upon cancellation of the subscription, this license is automatically revoked. The Partner must remove all Official Media from their digital and physical assets within 30 days of cancellation. Failure to do so may result in legal action.
5.4 Buyout Option: The Partner may elect to purchase a Perpetual Release for the Official Media for a one-time fee of £495 + VAT. Upon payment, the Partner owns the rights to use the images indefinitely.
5.5 Rescheduling & Missed Appointments: Cancellations or rescheduling requests for photography sessions made less than 48 hours before the scheduled time will incur a re-booking fee of £150 + VAT.
6.6 Listing Badge: Active Partners may display The Owners Club listing badges on their website and premises solely to indicate an active directory listing. Badges must not imply that The Owners Club has independently verified your insurance, qualifications, or workmanship. Upon termination, you must immediately remove all badges and references to listing status.
5.7 Your Content: By uploading logos, images, or other content to your profile, you grant The Owners Club a license to display this content on our platform for the duration of your subscription.
7. Limitation of Liability
The Owners Club is a self-service directory and advertising platform, not a service provider. We are not a party to any transaction or contract between the vehicle owner and the Partner. We accept no liability for any workmanship, vehicle damage, loss, disputes, or financial losses arising from services you provide. You agree to indemnify The Owners Club against any claims, damages, or legal costs arising from your listings, work, or business operations.
8. Data Protection
By using our platform, you agree to our Privacy Policy. We process your business information in accordance with applicable data protection laws worldwide, including UK GDPR, EU GDPR, and US state privacy laws where relevant. You are responsible for ensuring you have appropriate consent to share any customer data with us.
9. Changes to Terms
We reserve the right to modify these terms at any time. Material changes will be communicated via email to the address associated with your Partner account. Continued use of the platform after changes constitutes acceptance of the new terms.
